论我国终身教育立法的三个先行问题

The Core Issues of the Legislation on Lifelong Education in China

终身教育由于对公民塑造和教育事业可持续发展的强大作用而广受重视,立法推进成为国际社会的一项重要选择。我国于2001年开始终身教育立法的调研、起草任务,至今法律没有出台,凸显立法研究的不足。立法困境的突破很大程度上取决于三个先行问题的明晰。首先,我国当下是否已具备立法的基础和条件;其次,对于学者争论的"终身教育法"与"终身学习法"应如何基于我国的教育实际和立法现状做出最优选择;再次,如何在立法中诠释区别于《教育法》的独特性。

Since the concept of lifelong education has been put forward,it has been paid more attention because of its powerful role in promoting the sustainable development of national education. The international community has entered into the stage of development of legislation of lifelong education. China has also experienced a long period of preparation for legislation,whether it can be done depends largely on the first three issues. First of all,our country already has the foundation and condition of legislation. Secondly,in view of the reality of education in China and the status quo of legislation,the ＂lifelong education law ＂is still better than the ＂lifelong learning law＂. Finally,it is necessary to reflect the uniqueness of the legislation.
