摘要
"傍名"出版是一种文化乱象,是对出版秩序与原创精神的践踏。知名作品的书名是出版社营销的手段,是作者与出版社的智力成果,蕴含了作者与出版社的商誉。书名的法律保护包括著作权法模式、商标法模式、不正当竞争法模式。司法实践中,利用著作权法难以认定书名的独创性,运用商标法则费时费力。适用反不正当竞争法规制"傍名"行为、维护出版秩序是当前较为妥善的选择。
"Free riding" publication is a kind of cultural chaos. It is a violation of the publishing order and original spirit. The titles of well-known works are the means of the publisher' s marketing, the intellectual achievements of the author and the publisher, and the goodwill of the author and the publisher. Legal protection of titles includes copyright law model, trademark law model, unfair competition law model. In judicial practice, it is difficult to use the copyright law to determine the originality of the title, and the use of the trademark law takes time and effort. The application of the anti-unfair competition regulation system to "free riding" and maintaining publication order is currently a more appropriate choice.
