台湾“强保法”低投入高保障的法律分析

A Legal Analysis of Low Premium and High Security of Compulsory Automobile Liability Insurance Law in Taiwan

摘要 台湾"强制汽车责任保险法"为汽车伤害受害人构筑了"强制汽车责任保险"与"汽车交通事故特别补偿基金"双重给付保障机制,以高于大陆地区近四倍的保险保障在台湾良好运行。台湾强制汽车责任保险作为不以盈利为目的的政策性保险,专注于填补受害人的人身损害而放弃弥补财产损失,使得投保人缴纳较低的保费而获得高额人身保险保障,并赋予受害人直接请求权,便于受害人迅速获得保险保障。与此同时,"强制汽车责任保险法"所规定的汽车交通事故特别补偿基金,为弥补强制汽车责任保险的赔偿不足而设置,并通过代位求偿权保持资金的动态平衡,以使加害人因汽车事故造成受害人的损失在汽车责任保险和特别补偿基金两方面得到高赔付。 The "Compulsory Automobile Liability Insurance Law"in Taiwan establishes a double payment security mechanism for the victims of automobile injury,namely the "compulsory automobile liability insurance"and the "special compensation fund for automobile traffic accidents". The law works well with the coverage nearly four times more than that in the mainland. As the policy insurance not for profit,the compulsory automobile liability insurance focuses only on filling up the victim's personal injury but not on making up for the loss of property,which makes it possible for policy holders to pay"low input"premium but obtain"high"personal insurance protection,and at the same time,endow the victim with the direct claim right convenient for him to get the insurance protection quickly. On the other hand,the special compensation fund for automobile traffic accidents stipulated in the Law is set up to compensate for the insufficient compensation for compulsory automobile liability insurance and maintain the dynamic balance of funds through subrogation so that the inflictor who causes the loss of the injured person due to the traffic accident can get "high security " compensation from the"automobile liability insurance"and"special compensation fund".
