Views and Amendment Proposal on the 5^(th) Item of Article 25 Paragraph 1 of Patent Law

通过一个实际案例提出了《专利法》第二十五条第一款第(五)项和《专利审查指南》的规定"不一致"这一问题,通过对比国外相关法律法规,分析涉及该条款的专利申请现状,跟踪《专利法》相关条款的变迁,探讨立法本意,指出《专利审查指南》相关规定的合理性,藉此建议修改《专利法》的相关表述。

The issue of ＂conflict＂ between provisions of Guidelines for Patent Examination and the 5^（th） Item of Article 25 Paragraph 1 of Patent Law is presented through a real case. By comparing relevant laws abroad, analyzing the current status of patent application involved, tracing the amending history of Patent Law, and exploring the original legislative idea, the reasonability of Guidelines for Patent Examination is concluded, and an amendment to Patent Law is proposed.
