图片既可以作为现有设计,也可以作为现有技术。图片作为现有技术时,应当站在本领域技术人员的角度,将可以从图片中直接地、毫无疑义地确定的内容,认定为图片所公开的内容。对于需要主观推测得到的,不能唯一确定的内容,不能认定为图片公开的内容。对于尺寸特征,如果图片上没有明确的刻度,从图片上测量得到的尺寸特征,不能作为图片公开的内容。本案为涉及用外观设计及附图作为现有技术破坏涉案专利新颖性的案件,经历了专利复审委员会、一审法院、二审法院和最高院裁定,具有探讨的价值。

The drawings can be considered as prior design or as prior art. If the drawings are taken as the prior art, the disclosure of the drawings shall be identified according to the content that can be derived directly and unambiguously from the drawings at the point of view of the person skilled in the art. For content that requires subjective speculation or cannot be uniquely identified, it cannot be identified as disclosure of the drawings. For dimension features, if there is no clear scale in the drawings, the dimension feature measured from the drawings cannot be considered as disclosure of the drawings.
