In order to study the rules of use and validity of evidence in patent cases, this article analyzes the use of evidence and the opinions of both parties in Gleevec case, the effectiveness and basic requirements of different forms of evidence, the way of identifying evidence publication date, and the basic principle of using evidence were initially clarified.
