慈善项目的著作权法律保护探析

著作权法视阈下的慈善项目源于创意,成于作品,终于保护。以慈善项目的生成与运行为线索,慈善项目中的著作权可划分为前生成阶段、生成阶段和生成后阶段,每个阶段涉及的著作权问题各有不同与侧重。基于慈善项目的公益属性,一方面,慈善项目的著作权更应受到尊重与保护;另一方面,应选择＂分阶段、有侧重、类型化＂之保护路径,并构建主动保护与被动保护相结合之保护体系,切实有效地保护慈善项目的著作权,以从知识产权制度层面上激励和推动慈善事业的发展。
