我国老龄化背景下成年人意定监护制度的不足及完善

The Inadequacy and Perfection of the Adult Voluntary Guardianship System under the Background of China’s Aging Population

加快到来的老龄化社会对我国传统的监护制度带来了前所未有的挑战,为此新颁布实施的《民法总则》将《老年人权益保障法》规定的老年人意定监护制度扩展适用于全体成年人,确立了我国的成年人意定监护制度。但这些规定尚显粗疏、简单,尚有一定的缺陷,有待于进一步完善。

The accelerated aging society has brought great challenges to our traditional guardianship sys-tem, the new general provision of civil law for the first time stipulates the adult voluntary guardianship system on the basis of law on Protection of the Rights and Interests of the Elderly. But the rules are too principled and have some flaws.it is necessary to further improve the qualification, rights, termination and supervision of the guardian.
