Practice and Thoughts on Some Issues of Forensic Appraisal——from the Perspective of Zhejiang Province

在贯彻落实2017年中央全面深化改革领导小组审议通过的《关于健全统一司法鉴定管理体制的实施意见》和司法部《关于严格准入严格监管提高司法鉴定质量和公信力的意见》中,结合浙江省司法鉴定管理工作实践,探讨当前司法鉴定发展中司法鉴定机构、司法鉴定严格监管、司法鉴定管理与使用衔接以及司法鉴定进驻公共法律服务中心等热点问题,以期在以审判为中心诉讼制度改革中推进司法鉴定事业的向前发展。

For many years, the Zhejiang Forensic Appraisal Administration Office has addressed the problems in forensic appraisal management, such as the loose access control and the supervision, and the unsatisfactory overall development of the forensic appraisal industry. In the work, it follows the requirement of ＂strict entry control＂, ＂strict supervision, weed out the unfit and keep the fit＂, and ＂comprehensive measures, and strengthen supervision＂, and has received certain results. This article introduces the practice of forensic appraisal management in Zhejiang Province in implementing the ＂Implementation Opinions on a Unified Forensic Appraisal Management System＂, that was reviewed and approved by the Central Leading Group for Comprehensive Deepening Reform in 2017, and the Ministry of Justice＇s ＂Opinions on Strict Control of Entry, Strict Supervision and Improving Forensic Appraisal Quality and Public Trustworthiness＂, and discusses some hot issues in the development of forensic appraisals in the hope of advancing the forensic appraisal undertaking in the reform of the litigation system with trial as the center. At the same time, the article calls for speeding up the draft of the ＂Forensic Appraisal Law＂ to provide a reliable legal guarantee for the sustainable development of the forensic appraisal industry.
