Building a Community of Shared Future and Leading the New Development of China International Law

人类命运共同体理念的提出为推进中国国际法学的发展,增强其在全球范围内国际法理论及实践中的话语权和影响力提供了新的引领方向和政治动力。人类命运共同体理念的价值目标与国际法在本质与内涵上是相符的,是对传统国际法中国家主权原则的继承和发展。为实现构建人类命运共同体目标,中国提出、倡导并积极践行了一系列全球治理新原则,如共商共建共享原则、可持续安全原则以及合作共赢原则,意在推动它们成为新的国际法原则。法治化是推进全球治理体制变革和构建世界新秩序的必然要求。而要实现法治,就需要有良法善治,且推动构建人类命运共同体的法治路径应从国内法治路径和国际法治路径两个方向同时展开。

The concept of a community of shared future provides a new direction and political power to promote the develop- ment of China international law, enhance its worldwide voice and influence of international law theory and practice. The value target of a community of shared tuture is consistent with international law on the essence and connotation. It is also the inheritance and development of the principle of national sovereignty. In recent years, China has advocating and actively practicing a series of new principles of global governance, that is, the principle of discussing the co - construction and sharing, sustainable security and win -win cooperation, to construct community of human destiny and promote them as a new principle of international law. Under the rule by law is the inevitable demand tor promoting global governance system transtormation and constructing a new world order. The realization of the rule hy law requires the good law and the good governance. Theretfore, promoting the building of a community of shared tuture path of the rule by law should establish and improve rule by law at national and international lev- els at the same time.
