我国武装力量出境反恐的正当性研究

全球范围内非传统安全威胁持续蔓延,给地区国家发展和安全均带来了严峻挑战。我国周边地区反恐形势日益严峻,"一带一路"沿线国家和地区恐怖主义严重威胁我国日益增长的海外利益。在总体安全观下,维护国家安全要求我国向海外进行包括军事在内的战略利益拓展。武装力量出境反恐的正当性以法理价值、现实需求和实施效果为基本标准,以目的、条件和结果的正当性为内容。我国应当通过担当大国责任引导国际反恐新秩序,遵守国际法基本原则和联合国系列反恐条约决议,在联合国集体安全体制框架下采取武力反恐行动,完善法律体系,全方位做好反恐军事斗争的法律准备,实现武装力量出境反恐的正当性。

China should bear the responsibility to guide the countries through the law to the new order of international anti -terrorism, comply with the basic principles of international law and the United Nations Treaty Series of anti - terrorism resolutions, and take military counter - terrorism operations under the UN collective security system, make the full range of legal perfections of military struggle against terrorism.
