农村集体公共用地概念探析

An Analysis on the Concept of Rural Collective Public Land

在城乡二元结构体制下,农村集体公共用地长期被忽视,导致了农村基础设施和公共服务等供给的不足。除了理论界对农村集体公共用地制度缺乏深层次研究外,尚缺乏对农村集体公共用地概念的研究,造成该问题的一个重要原因就是对农村集体公共用地概念、性质等界定的模糊。因此,本文结合农村集体公共用地的法律实践考察结果,分析了农村集体公共用地的公物属性与内涵以及"农村+集体所有"的外延,以期对农村集体公共用地概念有一个准确的理解。

Under the dual structure of urban and rural division,rural collective public land has been neglected for a long time,which has caused serious supply of rural infrastructure and public service.The cause of the problem in present theoretical circles on the collective public land system lack of deep research,the concept of fuzzy nature positioning is an important reason.This requires a redefinition of the concept,and combined with the practice of rural collective public land investigation situation,through tracing the public with legal origin the clear collective public use of public service attributes and the connotation of the farmers＇ welfare,and ＂rural collective＂ extension for rural collective public use the concept of an accurate understanding.
