我国公民实现平等受教育权的现实问题探究——基于规范与事实的视角

摘要 我国现行宪法中明确规定,公民享有受教育的权利和义务。在对公民受教育权的保护中国家承担着重要角色,平等保护是宪法对国家保护公民受教育权提出的基本要求。但在现实中仍然存在着残障、贫困等群体以及因城乡地域差异而导致的教育不平等现象。同时在规范层面,教育政策不公平、教育行政机关腐败等因素也导致了公民受教育权的不平等。 China's current Constitution clearly stipulates that citizens have the right and obligation to receive education and the state plays an important role in protecting the right of citizens to receive education. Equal protection principle is a fundamental requirement of the Constitution for the protection of citizens' right to education. However,in actuality,there are still education inequalities among the disabled and the disadvantaged groups and between urban and rural areas. Meanwhile,from the perspective of norms,there are also many factors that lead to the inequality of the right to education-inequality of educational policy,corruption of educational administration,etc.
