在信息社会,对于企业来说,技术意味着实力,掌握着高价值的专利就能够在相关市场中占有一席之地,更有甚者直接带来市场支配地位。市场支配地位的认定难题在专利领域尤为突出,如何评估专利价值进而认定市场支配地位给反垄断执法带来了新的困境。本文从对专利价值有着重要影响的三大维度——技术、法律和经济进行深入剖析,力图构建起专利价值全方位评估的科学化体系,为专利领域市场支配地位的认定提供法律技术支撑。

In the information society, for enterprises, technology means strength, holding high value patents can occupy a place in the relevant market, and what is more, it directly brings market dominance. The identification of market dominance is especially prominent in the feld of patent. How to evaluate patent value and identify the dominant position of market brings new diffculties to the enforcement of antimonopoly law. From the perspective of three dimensions, which are important influence on Patent Value -- technology, law and economy, this paper tries to build a scientific system of patent value comprehensive assessment, providing legal and technological support for the identifcation of the dominant position in the patent market.
