主要研究网络证据的特点,通过网络证据对专利新创性的分析,结合网络证据的特点,研究在专利申请阶段如何全方位规避网络证据及被动的应对网络证据,以期在专利生存期规避网络证据的影响,且提出了网络证据统一管理、认定规范化的建议。

This paper mainly studies the characteristics of network evidence, and analyzes the new creation of patent through net-work evidence. Based on the characteristics of network evidence, the paper studies how to circumvent the network evidence in all di-rections and how to deal with the network evidence passively in the stage of patent application, in order to avoid the impact of net-work evidence in the patent lifetime, thus putting forwarda recommendation on unified management of network evidence and stan-dardization of network certification.
