摘要
网络用工对传统劳动法从属性理论及制度设计产生了冲击,使得现有劳动立法难以适应网络用工的发展,劳动者权益客观上难以得到法律的有效保护。要应对网络时代劳动用工的平权型、合作性、共享性用工特点及客观现状,需要革新劳动法理论,变革劳动立法,建构适应网络用工的劳动法律体系。
Online employment imposes impacts on the dependency theory and system design of the traditional labor law, and makes the existing labor legislation difficult to adjust to the network recruitment, and laborer 's rights and interests cannot be under legal protection effectively. To deal with the equality, cooperation, sharing and objective situations of the labor employment, we should innovate labor law theory, change labor legislation, and construct a suitable legal system for online employment of labor legal system.
