论生态环境的刑法保护

An Analysis of the Criminal Law Protection of Ecological Environment

从我国目前立法状况来看,对破坏生态环境的犯罪嫌疑人采取的处罚力度不够,无法对犯罪嫌疑人起到应有的惩治、震慑作用,致使人们的生态保护意识无法真正形成,不能有效遏制人们对生态环境的进一步破坏。为了保护我国的生态环境、培养公民的生态意识、规范公民的行为,建立健全生态环境的刑法保护体系已显得日益迫切。通过对生态环境现状及生态环境刑法保护中存在问题的分析,提出相应的生态环境刑法保护对策,以提高社会公民的生态环境保护意识、谋求生态环境的可持续发展。

From the present situation of our country＇s legislation, the punishment of the perpetrators who destroy the Ecological Environment is not enough to punish and deterrent the perpetrators, so that the Ecological Conscious- ness of the people can not be truly formed, and the further destruction of the Ecological Environment can not be effec- tively contained. In order to protect the Ecological Environment of our country, cultivate citizens Ecological Con- sciousness and standardize people＇s behavior,it is becoming more and more urgent to establish and improve The Crimi- nal Law protection system of the Ecological Environment. Through the analysis of the existing problems in the Ecologi- cal Environment and the protection of the Ecological Environment, this paper puts forward the corresponding counter measures to protect the Ecological Environment, so as to improve the awareness of the protection of the Ecological En- vironment of the social citizens and to seek the sustainable development of the Ecological Environment.
