摘要
在英国脱欧和美国特朗普总统大力推行"美国优先"政策等不确定性因素的影响下,美国商务部近期裁定韩国输油管市场存在"特殊市场状况",并据此对韩国出口到美国市场的输油管征收高额反倾销税。这是2015年美国颁布《贸易优惠延长法》后,美国商务部认定存在"特殊市场状况"的第一案,其中的"中国因素"值得引起我们重视。本文通过案例探讨"特殊市场状况"的实际效果,试图厘清美国政府的真实意图,分析其现实与潜在影响,尤其是未来对中国的可能影响,并据此提出中国的对策。
Under the influence of such unpredictable factors as Brexit and President Trump's "America First",the U.S.Commerce Department recently ruled that there existed a "particular market situation" in South Korea's oil and gas drilling pipes,which was regarded as the raison d'être for raising the anti-dumping duties.This was the first case ruled as a "particular market situation" by the Commerce Department since Trade Preference Extension Act came into effect in 2015-a case in which the "China factor" cannot be neglected.In this article,the authors analyse via case studies the real effect of "special market conditions",to discuss the real intentions of the American government,to examine its potential impact,and to offer some tentative suggestions.
