检察人员司法责任追究与免责范围的文本分析及完善建议

A Textual Analysis of the Scope of the Judicial Liability of Accountability and Exemption and Amelioration

司法责任制是司法改革的核心内容之一,检察机关在确保检察人员能维护社会公平正义上一直都在进行着制度设计,其核心是通过司法责任追究来倒逼案件质量提升。本文通过对检察机关司法责任追究与免责范围的制度梳理与考察,总结出我国在司法责任追究制度上存在着理念上的"机械主义"、重责任轻保障、概念界定和追责含义上的不确定性等问题,应通过扩大和细化检察人员免责范围的方式达到对检察人员司法责任追究与履职保障的平衡,确保检察权的有效和正确行使。

Judicial liability system is one of the core contents of the current judicial reform. The procuratorial organs have been carrying out the system design in ensuring that the procurators can maintain social fairness and justice. The core of the system is to improve the quality of the case through judicial liability.This paper analyses the scope of the judicial liability of accountability and exemption, summarizes the problems,including the mechanics of the judicial liability system＇s idea,the heavy responsibility and the light protection,the uncertain conceptual definition and the meaning of the liability. These issues should be solved by expanding and redefining the scope of the judicial liability of accountability and exemption,to ensure the effective and correct exercise of the procuratorial power.
