The article discusses the legal ＂identity＂of the British Quality Assurance Agency for Higher Education as a charitable company and its operational mechanism under the ＂identity＂framework. It maintains that QAA has the following operating features, including the independent exercise of civil rights, the representativeness and independence of the governance organization, the diversification and contracting of fundraising channels and methods, the democratic and self-governing of decision-making procedures, the independence of financial auditing system and the strict risk management mechanism. It concludes that the implementation and practice of the private law autonomy is the basis for ensuring the independence of legal entities.
