摘要
目前,我国的土地市场存在城乡二元分割的问题,有些乡村在没有立法支持的情况下自发流转集体建设用地,造成土地市场机制失灵。要想解决这一问题,就必须构建城乡统一的建设用地市场。而要想构建城乡统一的建设用地市场,就必须首先完善农村土地征收制度。当前,农村土地征收中存在"公共利益"和"农民集体组织"的界定不明确、征地程序不完善、补偿标准的制定缺乏依据、补偿金分配不合理等问题。只有完善土地征收制度,实现土地征收的合理化、公平化、规范化,才能为构建城乡统一的建设用地市场打下坚实基础,促进城乡统筹发展。
For a long time, the uneven development of urban and rural areas is not balanced, which is a prominent problem in the economic and social development. Under the premise of the two division of land market in urban and rural areas, the regional urban-rural relations are intertwined and complex in the process of urban and rural co-ordination development, showing various difficulties and problems, such as state monopoly land primary market, resulting in low economic efficiency, collective construction land under the absence of central legislative support, the market failure phenomenon caused by spontaneous circulation are all contrary to the goal of urban and rural co-ordination and economic and social harmonious development. So the constructive and effective countermeasures are to break the two plural land market of urban and rural areas, build a unified urban and rural construction land market, and build a unified urban and rural construction land market so as to solve the problem and speed up the land reform.
