我国体育社会组织承接政府购买服务的法律政策

Law and Policy of Sport Social Organizations Undertaking Government Purchasing Services in China

我国已经建立起政府购买服务的法律政策体系,但是对于体育社会组织承接政府购买服务的法律政策规定尚不完善。目前我国体育社会组织面临着不符合承接主体资质要求,缺少吸引和统筹社会资源能力,政社不分、内部治理混乱,难以获得购买主体信任及政府部门配合与支持的现实困境。体育社会组织承接政府购买服务的法律政策障碍体现在,体育社会组织登记注册门槛较高,承接服务的鼓励措施很少,承接主体资格要求较严,政府购买公共体育服务的专项立法较少。未来应当通过修法推行直接申请登记制度,适当调整体育社会组织承接购买服务条件要求,提供宽松有利的体育社会组织扶持法律政策环境,加快专项立法,健全政府购买服务法律政策体系。

China has established the legal and policy system of government procurement of services. However？ the legalpolicy provisions of social sports organization undertaking the government procurement of services are not perfect＊ Atpresent, Chinese sports social organizations is in face of many difficulties？ such as inconformity to the qualification requirementsfor undertakes？ and lack of ability of utilizing social resources. Meanwhile, the government still controls theorganizations. The internal governance is in chaos. It is difficult to obtain the purchaser＇s trust and the support of the governmentdepartments. The legal and policy barriers for sports social organizations undertaking the governmentprocurement of services is reflected in the registration, incentive measures, qualification requirements, specialized legislationof government etc. In the future, the law should be amend so that direct registration is allowed, requirements aremore reasonable, more supports are given, and legal system is established.
