摘要
艺术传播权利是艺术传播主体在人类社会政治共同体中天然享有的从事艺术交流传播行为的一种自由或资格。同其他权利一样,艺术传播权利也是人类主体性、自身利益和自由意志的彰显,具有明显的历史性、社会性、文化性特征,是人类发展到一定历史阶段的产物,并受到政治权力、社会舆论和法律权利等多重因素的影响。艺术传播权利不仅是艺术传播主体的权利,在很多情况下也由艺术生产主体和艺术接受主体所分享,它在艺术传播客体和艺术传播媒介中表征为权力,标志着人类感官的延伸。阐明艺术传播权利的内涵与边界,是建构健康的可持续发展的当代艺术秩序的必要环节。
The right of art communication is a liberty of or qualification for the behavior of art communication naturally shared by the subject of art communication in the human social and political community. Like other human rights,it is also a demonstration of human subject,self-interest and free will,so it is endowed with obvious historical,social and cultural features as a result of human evolution at a certain historical stage,and is affected by lots of factors such as political right,public opinion and legal right. The right of art communication is not only the right of the subject of art communication,but also,in many situations,is shared by the related subjects of both production and consumption of art; it is characterized as power in both the object and media of art communication,signaling the extension of human senses. To expound the connotation and boundary of the right of art communication is an indispensable link in building an order of contemporary art with sound and sustainable development.
