The Theory and Practice Logic of Regulatory Taking in Classic Case Logic: Differences between China and the United States and Policy Option

研究目的:探讨美国经典准征收案例对中国的借鉴价值。研究方法:案例分析法。研究结果:中美两国规划管制等基本制度存在较大差异,但政府在行使警察权和保护财产权、给予被管制人互惠利益、审查目的和效果关联等方面值得中国借鉴。研究结论:中国具有准征收问题,对准征收的判定或财产权的保护适用征收保护条款,即公共利益、正当程序和公正补偿。中国需要对土地的初始权利进行明确定义,但这需要有关制度的配合。

The purpose of this study is to explore the reference value of American classic regulatory taking（RT） cases. The research method is case analysis. The results are as follows： the basic system of planning and regulation between China and the United States is quite different, but the implementation of police power, the protection of property rights, the reciprocal interests grant of the regulated persons, the review of relationship between purpose and effectiveness are worthy of our reference. In conclusion, the RT issues appear in China, the determination of the RT or the protection of property rights use may apply the terms of taking, including public interest, justice process and fair compensation. China needs to define the initial rights of land, but it requires the cooperation of the related institutions.
