摘要
信息不对称是消费者合同领域的核心论题。为了解决信息不对称问题,信息披露乃是最为关键的制度之一。而行为经济学的研究成果表明,消费者在决策中往往无法通过单纯的信息提供达到福利最大化。要有效矫正信息不对称,应当将重点放在消费者对信息的接受能力和处理能力上,提升和细化消费信息内容的重要性、披露方式的显著性与可得性。
Asymmetric information has been confirmed as the main problem in consumer contract. In order to solve the predicament of information asymmetry and the imbalance of market power, the information disclosure scheme is a crucial part of consumer protection policy. However, behavior economics theory reveals that the flaws of the strategy are mainly from the ignorance and carelessness of consumers themselves, and these factors make the decision making progress fails in purpose of rational choice. According to behavior economics analysis, the information disclosure system still has necessities to be improved. One shall see the resolution in these aspects:(a) The significance of the information which reveals in contracts;(b)The way of how information is disclosed;(c)The availability of relevant information.
