包容性法治社会建设论要

On Construction of Inclusive Society with Rule of Law

改革开放进入新时代,中国经济由高速增长阶段转向高质量发展阶段,社会主要矛盾发生变化。经济发展所遮蔽的转型期社会矛盾不断显现,表现在价值观、身份认同、社会分层、社会共识以及社会治理模式变迁等诸多方面。为了有效应对因经济新常态而带来的社会转型的掣肘,系统性、协同性法治思维和法治化方式可以引发我们对机制、秩序、治理能力等问题的深入思考,以型构一个更具包容性的法治体系,建设高质量的"法治社会"。包容性内涵"自治、宽容、开放"特质并立基于"人的团结、人的平等、人的参与",通过"社会共享"、"社会融合"和"社会参与"等要素,可以激发社会治理的内在动力并构建包容性法治社会的发展体系,即能力层面的自治诉求、机制层面的兼容性发展以及秩序层面的开放性结构。能力建设强调自治权基础上公民意识和宪法爱国主义的可行能力,机制建设祈求为弥合社会分化而建立多元规则的兼容系统,秩序建设希望建立达致良法善治的共治结构。

In the new era of reform and opening up, China＇s economy has shifted from the stage of rapid growth to the stage of high quality development, and the major social conflicts have changed. The social contradictions in the transition period covered by economic development are emerging, which are manifested in many aspects such as values, identity, social stratification, social consensus, and social governance mode. In order to effectively deal with social transformation brought by economic new nor- mal, systematic, collaborative mechanism of rule of law thinking and way of government by law can stimulate us to think deeply about the problems of the governance ability, construction of a more inclu- sive type of rule of law system, and ＂the norm of the rule of law society＂. The connotation of ＂autonom- ic, tolerant, open＂ characteristics based on the ＂unity, equality and participation＂, including the con- notation of ＂social sharing,＂ ＂social integration＂ and ＂social participation＂ and other elements, can stimulate the intrinsic motivation of social governance and build an inclusive society with rule of law, namely, autonomic demands at the ability level, development at compatibility mechanism level, and the open structure at order level. Capacity construction emphasizes autonomy on the basis of citizen con- sciousness and the feasible ability of constitutional patriotism. Mechanism construction bridges social differentiation and establishes rules compatible systems. Order construction hopes to achieve good law and governance structure.
