Different Views on the Legislative Decision Making Opinions of Denying the Personality Right Law of the Civil Code

《民法总则》制定完成之后,编纂民法典分则各编的工作有序展开,其中有学者对民法典分则设置人格权编的立法决策,以及民法典人格权编草案征求意见稿提出否定性意见。这些意见似是而非,没有科学的理论基础,不尊重客观事实,缺乏理性的逻辑论证,因而不能否定民法典人格权编草案征求建议稿服务于中国改革开放新时代社会发展的大方向,更不能否定该征求意见稿尊重人民的人格尊严,保护人民当家做主的地位,保护好人民的人格权的立法价值。立法机关正在将民法典分则各编草案在内部征求意见,力图将其修改得更好,成为一部好的民法典分则,其中就包括人格权编。对于民法典分则各编包括人格权编草案,每一个人都可以对其提出修改和完善的批评意见,但应避免无价值的争论,以便经过专家学者和立法机关的共同努力,把民法典分则草案各编修改好,完成我国编纂民法典的伟大历史任务。

After the completion of the General Principles of the Civil Law, the compiling of the subsections of the Civil Code has been carried out in an orderly manner. Some scholars hold negative opinions on the decision making opinions of establishing the Personality Right Law of the Civil Code and the draft for advice of the Personality Right Law of the Civil Code. These opinions are specious and lack of scientific theoretical basis, show no respect for objective facts, and are tack of rational logical arguments. Therefore,we cannot deny that the draft for advice of the Personality Right Law of the Civil Code serves for the general direction of China＇ s reform and opening up of the social development in the new era. And we cannot even deny that the draft for advice of the Personality Right Law of the Civil Code respects people＇ s personal dignity, protects people ＇ s status as the master, and also protects the legislative value of the personality right. The legislature is in the process of soliciting opinions on the drafts of subsections of the Civil Code to modify them better, including the Personal Right. Everyone can make criticism of the amendments and improvements of the subsections of the Civil Code, including the Personal Right. However, they should avoid the valueless arguments, so that we can better revise the drafts of the subsections of the Civil Code through the joint efforts of experts, scholars and the legislature to complete the great historical task of compiling the Civil Code in China.
