同步录音录像制度功能与适用问题研究

我国《刑事诉讼法》二元式的立法模式为侦查机关选择性适用录音录像提供机会,也为该制度的异化适用留下伏笔。在同步录音录像的三重功能发挥上,应从重视"规范侦查取证行为"的本源性转向强调"查明案件事实"的功利性上,以增强侦查人员适用该制度的积极性。鉴于同步录音录像制度的重要性的凸显,应当明晰其证据属性,并根据证明的内容来确定其证据种类及适用规则。解决同步录音录像与讯问笔录不一致的根本办法是优先适用同步录音录像。在同步录音录像的制作与使用上应坚持"制作过程全部涵盖,播放过程适度选择"的原则。与此同时,要认识到同步录音录像制度的局限性,加强侦查人员诉讼观念的转变以及证明方式的转型。

The binary types of legislation provide the chances for the investigation organs to use the audio and video selectively, which give the fore-showing for the alienation of applying the system. In order to promote the investigators to apply the system,we should focus more on ＂finding the facts＂ than ＂regulating the behavior of investigation＂. In view of its very importance, we should give the evidence attributes for the audio and video synchronization, and determine the types and applicable rules according to the proof of the contents. The basic method to solve the inconsistent contents between the audio and video synchronization and interrogation records is to use the former replaces the latter. In the production and application of the audio and video synchronization,we should adhere to the principle of ＂producing all, playing selectively＂. Meanwhile, we should realize the limits of the system, and strengthen the idea transformation of the investigators and the proof models.
