对海外代购行为刑法规制的思考

随着近年来互联网电子商务的发展,淘宝、微信、网易考拉等网络商品交易平台大大满足了人们日常生活的物质需求,越来越多的人们通过网络渠道获得自己心仪的商品。我国海外代购市场近年来的交易规模成倍成倍的增长,在这种增长背后显然有一个巨大的"灰色地带",即实质的"走私"。目前我国还没有出台针对性的法律来规范海外代购行为,海外代购的罪与非罪界限也十分模糊,不法的海外代购行为也普遍得不到刑法的规制。

As the development of electronic commerce in recent years,the Internet,taobao,We Chat,netease koala network commodities trading platform greatly satisfy the material needs of People＇s Daily life,more and more people through the network channels to obtain the desired goods.The scale of transactions in China＇s overseas purchasing market has doubled in recent years,and there is obviously a huge ＂gray zone＂ behind such growth,namely the ＂smuggling＂ of substance.At present our country has not yet issued specific laws to regulate the behavior of purchased overseas,overseas act as purchasing agency of crime and is not a crime boundary is fuzzy,illegal overseas purchasing behavior is generally not to the rules of criminal law.
