The Legal Regulation of Artificial Intelligence Security:Reflection from the System Security Perspective

人工智能技术的广泛使用,在带来科技红利的同时,也衍生了一系列社会风险。文本重点关注人工智能安全的法律治理,依据我国现有网络安全法律体系,结合人工智能技术与应用发展现状,对人工智能带来的新生网络安全风险进行挖掘。文本基于系统安全问题展开论述,通过对人工智能含义试析及应用类型的概括分层,提炼出人工智能系统安全风险的核心要素。同时,探索在我国现行网络安全法治体系下,人工智能系统安全法律治理的切入点,并就具体问题提供相关建议与若干探讨。

The extensive application of Artificial Intelligence（AI） technologies has brought people benefits of science, as well as a series of social risks. This paper focuses on the legal regulation of AI security. Based on China＇s current cybersecurity legal system, and combined with the applications of AI technologies, it explores the new cybersecurity risks brought by AI, especially, the issues of system security. By analyzing the definition of AI and summarizing the hypothesis of its application, it tries to illustrate the core elements of AI related risks. At the same time, this paper explores the breakthrough point of AI system security legal regulation under the current cybersecurity related legal system of China, and provides several suggestions and reflections on these specific issues.
