新疆古村落保护立法问题研究

A Research on Legislation for the Protection of Old Villages in Xinjiang

新疆作为一个多民族地区,有着悠久而灿烂的多民族文化,多元一体的文化的基因、根性、文化脉络和历史记忆大多在村落里。通过立法加强对古村落的保护,蕴含"求同存异"的价值取向,有助于中华视野下少数民族文化的展现,有助于强化新疆各民族的中华民族共同体意识。2015年对《中华人民共和国立法法》进行修订,赋予设区的市、自治州地方立法权,新疆也面临地方立法主体扩容的情况,在此背景下,古村落保护也属此次立法主体扩容后的立法事项,文本阐述了新疆古村落保护的重大意义、实施关键及不同层级的立法主体对古村落保护的立法策略。

As home to many ethnic groups, Xinjiang boasts a long tradition of ethnic cultures, particularly rooted in those old villages scattered in various parts of the region. Protecting these old villages through legislation helps people of the ethnic groups identify both with their own cultural tradition and with the greater Chinese nation. The 2015 revision of The Legislation Law of People＇s Republic of China granted legislation rights to cities and autonomous prefectures with their own the rights to make their own administrative districts. Xinjiang has many such cities and autonomous prefectures. In this context, the protection of old villages is one of the subjects for legislation. We expect to discuss the significance of protecting old villages through legislation, and important measures to be taken in the process of legislation at different levels of local governments.
