从甲磺草胺专利案分析我国农药企业应对美国“337调查”策略

Analysis of China's Pesticide Enterprises' Response to the United States' "337 Investigation" Strategy from the Sulfuramide Patent Case

发起门槛低、申请立案易、程序简单、耗时短、打击面广、不易招致报复且能有效排斥进口的美国337调查,是美国政府保护本国产业和市场最为有利的武器之一。本文结合近期涉华的农药案例进行分析,提出应对建议和策略,期望有助于我国相关农药企业从不同层面采取措施更有效地应对337调查。

337 investigation is one of the most advantageous weapons to protection of domestic industries and markets in the United States, because of its low barriers to entry, easy filing, easy procedures, short time-consuming, wide range of strikes, difficulty in retribution, and effective exclusion of imports. This article analyzes the recent cases of pesticides in China, and proposes countermeasures and suggestions. It is expected that the relevant pesticide companies in China will adopt measures from different levels to respond more effectively to the 337 investigation.
