How to deal with the executory contract of the bankruptcy reorganization in the real estate enterprise is not only the focus of reorganization plan but also refers to the homebuyer＇s life quality and stabilizing social order,because homebuyers are the largest number of the creditor in the process of real estate enterprise operation,and most of homebuyers buy the house to live in. Meanwhile,there are many kinds of interested parties in the process of the bankruptcy reorganization,so the social effects and the stability of the economic order in the bankruptcy reorganization are significant. Considering the bankruptcy reorganization＇s particularity in real estate enterprise,the most important is how to conduct the executory contract of house,and this determines the protection of homebuyer ＇s right,the settlement of the real estate enterprise＇s obligatory right or debt and the smooth progress of bankruptcy reorganization proceeding. This article finds some problems of the executor contract of house about using law and disposing by researching on it. In order to solve the executory contract in a right way,this article focuses on the law of the executory contract application conditions,analyzes the shortcomings of the current legal system and explains the interests that should consider when using the law.
