摘要
在目前已经进行的十六轮中欧投资协定谈判中,中欧双方在ISDS机制问题上仍然无法达成共识。欧盟在提出建立国际投资法院制度的《跨大西洋贸易与投资伙伴协议》投资章节草案时曾经指出,该投资章节草案不仅适用于欧盟与美国的贸易谈判,而且还将适用于欧盟与其他国家正在进行的以及未来将进行的谈判。若在中欧投资协定谈判中提出,现阶段不宜贸然接受投资法院提议。但这并不代表永远不接受,投资法院是国际投资制度化发展无法避免的结果,更加符合国际投资法治的发展趋势。中国应当借"一带一路"倡议的实施,在国际投资谈判和争端解决的过程中充分积累经验、提升在国际投资领域中的话语权,早日形成有中国特色的ISDS条款,为日后接受投资法院争端解决机制条款努力。
After sixteen rounds of negotiation on Sino-EU Bilateral Investment Treaty to date,China and EU still fails to reach a common ground in ISDS. In the draft of the Investment Chapter of Transatlantic Trade and Investment Partnership,puts forward the idea of Investment Court System,EU proposes that this chapter not only applies to the trade negotiations between EU and US,but also to the on-going and upcoming negotiations between EU and other countries.For China,it is not appropriate to accept the Investment Court System proposal at this stage.However,in order to meet the trend of the Investment Court System,China should strengthen the training of talents in the field of international investment law and accumulate experience in the negotiation of international investment agreements and in the settlement of international investment disputes.With the strategy of the Belt and Road Initiative,China should accumulate experience in the negotiation of international investment agreements and the settlement of international investment disputes,raise its voice in the international investment,propose ISDS clauses with Chinese characteristics,so as to make preparation for the acceptance of the dispute settlement mechanism of the Investment Court System in future.
