论国家自卫权与国家自由——以《民报》为考察对象

On Power of National Self-defense and National Freedom——Taking Citizen's Newspaper as Object of Study

国家自卫权是国家自由的重要组成部分。《民报》学人认为,国家自卫权是一个国家为了避紧急、直接之危难,而不得不侵害他国权利的行为,但是必须止于一定的范围之内。国家自卫权虽然在一定程度上可以限制强国对弱国的任意侵夺,但是也为强国滥行国家干涉提供了一定的法理依据。

The power of national self-defense is an important part of international freedom. Writers of the Citizen＇s Newspaper thought the power of national self-defense is a behavior that a country has to encroach on the rights of other countries in order to avoid emergency and direct danger,but it must be confined to a certain range. The power of self-defense can limit the arbitrary trespass of the weak country against the strong country,but it also provides a legal basis of arbitrary interference of the state.
