从《天津市促进商业发展若干规定》的制定谈地方立法问题

Discussion on Some Problems of Local Legislation from the Formulation of “Several Regulations on Promoting Commercial Development in Tianjin”

地方立法对本地区经济社会发展发挥着引领推动、保障促进等多重功用。《天津市促进商业发展若干规定》作为促进型地方立法项目,旨在促进天津商业健康发展,推动解决商业领域存在的若干突出难点问题。本文以该部法规为例,分析阐述了立法主导思想确立对地方性法规基本立法取向的决定性作用,并从立法体例、法规针对性两个方面对地方立法普遍性规律作了思考,从制定标准、长期性、阶段性特征两个方面对促进型地方立法的特殊性作了深入研究。

Local legislation plays a leading role in promoting the economic and social development of the administrative region. ＂Several Regulations on Promoting Commercial Development in Tianjin＂,as a promoting local legislative project,aims to promote the healthy development of Tianjin＇s business and the solution of some prominent and difficult problems in the business field. This paper takes the law as an example,analyzes the decisive role of the establishment of the legislative guiding ideology in the orientation of the basic legislation of local regulations,makes some thinking on the universal law of local legislation from two aspects of legislation and regulations,and researches deeply on the particularity of promoting local legislation from the formulation standards and long-term stage characteristics.
