A Study on Rural Social Governance in China——An Analysis based on the Commonwealth Order in the Context of “Living Law”

十八届四中全会以来,依法治国的重要领域和关键环节改革取得突破性进展,开启了中国特色社会主义法治的新时代。然而我们可以发现,在相对落后的农村地区,并非所有的国家法都发挥了预期的作用,整合农村基层法律资源实现国家法与其他社会控制力量的良性互动,这一过程仍然艰难而又复杂。相反,形成于社会生活中并为大家所认可的联合体内部规则在社会治理中发挥着更大的作用。

The key fields and links of Rule of Law have made a great progress Since the Communiqué of the Fourth Plenary Session of the 18 th Central Committee of the Communist Party of China, which turn a new leaf of Socialism with Chinese characteristics and the rule of law. Nevertheless, not all national laws work well in the underdeveloped rural areas, and the process of combining the sources and realizing the win-win interaction between national laws and rural legal resources is still hard.and complex. And on the contrary, familiared by the residents, the internal rules formed in daily life in a semi-enclosed society works better. Based on the inspiration of Ehrlich＇s＂living law＂, this paper focuses on the exploring of the internal relationships between the rural and finding its role in the way of maintaining the order, which might find a new idea of rural social governance.
