纪检监察制度改革:从“两规”到留置

Discipline inspection and supervision system reform: from “two regulation to the alien”

党的十九大报告作出了将国家监察体制改革试点工作在全国范围内推开的重要决定。其中,"用留置取代‘两规’措施"作为配合监察委员会职权运行的调查手段备受瞩目。一词之变,彰显的是反腐败调查措施的规范化、法律化,折射出"二元反腐败治理结构"向法治反腐的模式转变,具有重大的法治意义。据此,应更好地细化和规范留置措施,切实实现这一手段的功能,同时亦必须契合《中华人民共和国宪法》中"尊重和保障人权"的精神。

The report of the 19 th National Congress of the CPC made an important decision to push the pilot program of the reform of the state oversight system across the country. Among them,＂the use of the alien instead of‘two regulation＇＂has drawn much attention as a means of investigating the operation of the powers of the Commission. The change of the term demonstrates the standardization and legalization of the anti-corruption investigation measures and reflects the shift of the mode of ＂dual anti-corruption governance structure＂to the anticorruption work of the rule of law,which is of great legal significance. Therefore,how to better refine and standardize the measures of indoctrination and effectively realize the function of this measure,at the same time,should also achieve the link with the spirit of ＂respecting and safeguarding human rights＂of the Constitution.
