摘要
"春秋决狱"作为一项独特司法制度,主张以儒家经典指导司法断案,并以"原心定罪"及"亲亲尊尊"作为其适用的基本原则。"春秋决狱"作为一把双刃剑,其所产生的利弊影响对现代刑事活动具有重要借鉴意义。现代刑事活动应遵循主客观相一致的入罪原则,引入判例法的审判模式,注重厘清法律与道德的关系界限,并将"亲亲相隐"的原则有效地引入刑事立法之中。
＂The trial during Chunqiu＂as a unique judicial institution,advocated that using Confucian classics to guide judicial resolution,and taking＂Yuan Xin Ding Zui＂and＂Qin Qin Zun Zun＂as basic principles of its applying.As a double-edged sword,the advantages and disadvantages of＂The trial during Chun qiu＂has an important referential significance in modern criminal activities. Modern criminal activities shall follow the principle of subject and object consistent in conviction,bring in the case law trail mode,pay attention to clarify the relationship boundary of law and morality,and let＂Kin Concealment＂principle bring into the criminal legislation effectively.
