摘要
随着社会的转型变革、社会竞争的日益激烈,工作压力的增加导致劳动者普遍过度劳动,使得过度劳动现象被社会各界普遍关注。通过对于过度劳动形成的原因以及危害进行分析,得出对于过度劳动的法律治理是构建现代健康和谐的劳动关系不可或缺的法律措施。这些措施不应只关注事后救济,而应该通过加强事前预防、完善社会保障机制、发挥劳动监察的作用以及构建多元化的过度劳动救济措施,来实现对于过度劳动标本兼治的目标。
With the transformation and transformation of society and the increasingly fierce competition in the society,the increase of working pressure has led to the general overwork of workers,which has aroused widespread concern from all walks of life. Through the analysis of the causes and harms of excessive labor,it is concluded that excessive labor legal governance is an indispensable legal measure for building modern healthy and harmonious labor relations. These measures should not only focus on the relief afterwards,but should be achieved through strengthening prevention and improving social security mechanism,giving full play to the role of labor supervision and constructing diversified and excessive labor relief measures.
