摘要
外卖餐盒的消费随着互联网技术和外卖平台的发展急剧膨胀,其废弃处理给环境带来了极大的负担。相比较典型的环境法规制对象,外卖餐盒引发的环境问题具有单个主体少量排污,整体排污规模庞大的特点,当前的环境法规范难以适用。基于法社会学和环境资源法理论,结合"限塑令"的社会实效,外卖塑料餐盒应当采用经济手段加以规制。在这一视角下,餐盒费可以成为限制外卖塑料餐盒消费的突破口。
The consumption of takeout packages has been exploding along with the development of online takeout order platform, which is a huge burden to the environment. The problem is severe, and the typical and current environmental regulation would be weak in its application because the pollutant source is dispersive with every single consumption of takeout.Based on the legal sociology and environmental law theories, and the social outcome of "ban on free plastic bags", the consumption of takeout packages shall be restricted by economic measures. From this point of view, the package fee may be a breakout.
