论我国“孤儿作品”版权保护制度的完善

On the Perfection of Copyright Protection System for Orphan Works in China

互联网信息技术的迅速发展,一定程度上给作品的版权管理带来了挑战,尤其体现在孤儿作品的版权保护上。在我国现行法律法规中,对孤儿作品版权保护方面的规定存在较大的完善空间。世界上其他国家尽管在孤儿作品版权保护方面有一些较为成功的实践经验,但并不完全适合我国国情。因此,在参考他国实践经验、考虑本国国情的基础上,可以从完善孤儿作品的版权集体管理组织、建立孤儿作品的版权备案登记制度和明确"尽力查找"与提存费用的标准三个方面完善我国的孤儿作品版权保护制度。

In recent years,due to the rapid development of internet information technology,the copyright management of works has been challenged to some extent,especially the copyright protection of orphan works. In Chinese current laws and regulations,there is relatively large room for the improvement of orphan works＇ copyright protection. Although other countries in the world have some comparatively successful practical experience in terms of the copyright protection of orphan works,they are not entirely suitable for China＇s actual conditions. Hence based on the practical experience of other countries and taking into account China＇s national conditions,it can be suggested to perfect the copyright＇s collective management of orphan works,build a copyright registration system for orphan works,and explicitly define the ＂best effort＂and the standard for drawing up fees in order to perfect the copyright protection system for orphan works in China.
