我国多边环境条约实施机制研究

Research on the Implementation Mechanisms of Multilateral Environmental Treaty Provisions in China

多边环境条约的实施机制对于促进多边环境规则的遵守具有重要作用。环境问题,尤其是全球性环境问题的积累性、长期性和损害的不可逆转性,决定了环境问题的解决需要采取长期的和预防性的解决方法。科学上的不确定性和对要求的解决办法存在的认识和政治上的分歧导致环境义务大多非常模糊、抽象,缺失严格的可操作性。我国应提高全民环境保护与可持续发展意识,加强对环境问题和实施机制的研究,充分利用各项多边环境条约规定的实施机制,加强遵守多边环境条约义务的能力建设,积极参与多边环境规则的谈判并开展环境外交。

The implementation mechanisms of multilateral environmental treaty provisions have an important role to play in promoting compliance of multilateral environmental rules. The environmental problems, especially the accumulation, long-term and irreversible damage of global environmental problems, that determined the solution of environmental problems which need long-term and preventative approaches. The scientific uncertainty and required solutions in the cognitive ability and political disagreements lead to environmental obligations that are ambiguous, abstract and lack of strict operability. China should raise the public awareness in environmental protection and sustainable development of the whole people, strengthen the research on environmental problems and implementation mechanisms,make full use of the implementation mechanisms at various levels of multilateral environmental treaty provisions, enhance the capacity building of compliance with multilateral environmental treaty provisions, actively participate in the negotiation of multilateral environmental rules and broadly develop environmental diplomacy.
