“大数据”时代网络个人信息的保护——以“人肉搜索”事件为例

Protection of Internet Personal Information in the Age of “Big Data”——Taking “Cyber Manhunt” as an Example

通过对"人肉搜索"事件样本的比较分析,总结其中蕴含了侵权者无责和受害者无助等问题,以及网络个人信息的立法零散与司法无序的保护现状。提出我国可尝试立法保护和行业自律相结合的模式,制定符合我国国情的《个人信息保护法》,同时探索推行电子诉讼,努力解决互联网法院建设中的困境,使网络个人信息具有更强的司法保护。

Through the comparative analysis of the samples of＂cyber manhunt＂,we can summarize the existing problems thereof： the infringer may have no responsibilities; the victim may find it hard to get relief; the current legislative and judicial protection condition is out of order. The paper puts forward that we can apply the mode of combining the legislative protection with the self-discipline of the industry to make it possible for the online personal information to get stronger judicial protection. We should make Personal Information Protection Law in accordance with our national conditions. We can develop the online litigation and try to solve the difficulties of the construction of the Internet court.
