我国公共图书馆法人治理结构建设的内在逻辑、现实困境与实施策略

Internal Logic,Realistic Predicament and Implementation Strategy of the Construction of Corporate Governance in Public Libraries in China

我国公共图书馆法人治理结构建设以治理逻辑为起点、以法律逻辑为依据、以理论逻辑为支撑、以实践逻辑为呈现,其内在逻辑揭示了公共图书馆法人治理结构建设的现实缘起、法律依据、理论支撑和实践表现。当前,公共图书馆法人治理结构建设面临诸多现实困境:因研究视野狭窄而导致的理论困境,因政事关系不协调而导致的体制困境,因法制不健全而导致的法律困境,因治理结构不完善而导致的内部治理困境,因参与机制不健全而导致的多元主体共同治理困境。为破解公共图书馆法人治理结构建设的这些现实困境,需要不断强化基础理论研究,深化公共图书馆治理认知水平;推动政事关系改革,提升公共图书馆的法人自主权;加强法律制度供给,构筑公共图书馆治理法制保障;完善内部治理功能,优化公共图书馆治理运作机制;创新治理运作模式,构建公共图书馆共同治理体系。

The construction of corporate governance structure of public libraries in China is starting from governance logic,according to legal logic,supported by theoretical logic and presenting as practical logic. Its internal logic reveals the realistic origin,legal basis,theoretical support and practical performance of the construction of the corporate governance structure of the public library. At present,the construction of the corporate governance structure of the public library faces the theoretical dilemma caused by the narrow field of vision,the system dilemma caused by the disharmony of the relationship between government and public service institutions,the legal predicament caused by the unsound legal system,the internal governance dilemma caused by the imperfect governance structure,the plural subject common governance dilemma caused by the incomplete participation mechanism. To solve the realistic predicaments of the construction of the corporate governance structure of the public library,these measures need to be taken： strengthening the basic theory research to deepen the cognition of public library governance; promoting the reform of political relations to improve public library legal autonomy; strengthening the supply of the legal system to build public library governance legal protection; improving the internal governance function to optimize the public library governance mechanism; optimizing the operation mode to build a common management system of the public library.
