摘要
大数据时代的到来为作品的传播带来了更大机遇与空间,但因网络不可对作品进行特有署名的特点而产生越来越多的孤儿作品,因此对这些作品在法律上的认定与管理也带来了前所未有的挑战。通过对大数据的利用建立完善的作品录入通道,并在此基础上,研究和讨论构建以公共文化机构对孤儿作品进行集中管理与保护的制度是解决相关问题的合理途径。
The arrival of big data era has brought greater opportunities and space for the dissemination of works. However, more and more orphan works are produced due to the specific features of network works which can not be signed in person on the Internet. So it has become an unprecedented challenge to legally recognize and manage the network works. By means of big data, we can establish a perfect entry channel for works. On this basis, we put forward the view that it is a reasonable solution to the related problems to study and discuss the system of centralized management and protection of orphan works by public cultural institutions.
