在详细介绍了现行宪法第五次修改工作的全过程的基础上,分析了此次修宪相对于现行宪法前四次修改所具有的特征,指出现行宪法的第五次修改工作具有一定的独立性,早于党的十九大启动,同时在宪法修改过程中结合了党的十九大精神,并把党的十九大提出的一系列重要理论观点、重大方针政策,特别是习近平新时代中国特色社会主义思想写入宪法,使得党章规定的指导思想通过宪法修改转变为宪法所肯定的国家指导思想,保证了执政党执政理念的完整性和统一性。此次宪法修改还完善了五项宪法制度,其中国家主席任期制度和宪法实施监督制度都是原来就有的,通过这次宪法修改进一步加以完善;宪法宣誓制度、国家监察制度和设区的市享有地方立法权制度是通过宪法修改在宪法中新增设的制度。通过上述修改使得现行宪法能够始终与执政党的大政方针保持价值理念和制度逻辑上的一致性,确保宪法与社会现实相适应,充分体现了现行宪法与时俱进的品格。最后,分析了此次宪法修改所体现的执政党依宪治国、依宪执政的决心、信心和行动力,指出现行宪法的第五次修改强调了宪法的规范指引作用,弘扬了宪法权威,有助于推动全面依法治国各项法治工作的有序进行,同时也为践行党的十九大提出的"加强宪法实施和监督,推进合宪性审查工作"提供了坚实的宪法基础。

This paper describes in detail the entire process of the fifth revision of the current constitution and the characteristics of the revision of the current Constitution relative to the previous four revisions of the current Constitution,and points out that the fifth revision of the current Constitution has a certain degree of independence,earlier than the 19 th National Congress of CPC,at the same time in the process of constitutional revision,incorporated with the spirit of the Nineteenth National Congress of the Communist Party,especially the series of important theoretical viewpoints and major policies proposed by the Party＇s Nineteenth National Congress,in particular,Xi Jinping thought to the socialism with Chinese characteristics for the new era. The ideology was written into the Constitution and the guiding ideology defined by the party Constitution was transformed into the national guiding ideology affirmed by the Constitution through the revision of the Constitution,in order to ensure the integrity and unity of the governing idea of the ruling Party. In addition,the paper points out that the constitutional revision also improves the five constitutional systems,including the tenure system of the chairman of the country and the implementation of the constitutional supervision system,all of which existed,and are further improved through the constitutional amendment; the constitutional oath system and the national monitoring system,the municipal citys with divided districts to have the right to local legislative power through the constitutional revision are of the newly established system in the Constitution. Through the above-mentioned amendments,the current Constitution can always maintain the logical consistency of values and systems with the ruling Party＇s major policies,ensure that the constitutions are compatible with social reality,and fully reflect the current constitutional character of advancing with the times. Finally,the paper also analyzes the determination,confidence and action power of the ruling Party in accordance with the constitutional governance and the implementation of the Constitution in accordance with this constitutional revision. It points out that the fifth amendment of the current Constitution emphasizes the normative and guiding role of the Constitution and promotes the constitutional authoritativeness which will help promote the orderly implementation of various rule of law issues in the comprehensive management of the country＇s laws,and it also provides a solid constitutional basis for the implementation of the＂enforcement of constitutional implementation and supervision and promotion of constitutional review work＂put forward by the Party＇ s Nineteenth Congress.
