习近平新时代中国特色社会主义思想的宪法学分析

Constitutional Analysis of “Xi Jinping The Thought on Socialism with Chinese Characteristics for a New Era”

党的十九大修改了党章,将习近平新时代中国特色社会主义思想写入其中,成为中国共产党的指导思想,进而在宪法修正案之中得到确认,又成为了国家的指导思想。它本身是对宪法规定的邓小平理论的发展,由此决定了习近平新时代中国特色社会主义思想与宪法规定的邓小平理论具有内在的一致性,不仅对党政机关,而且对公民和社会组织都具有规范的效力。不仅如此,由党章确认的党的指导思想经过宪法确认为国家的指导思想,也是我国宪法变迁的一种形式,充分体现了中国共产党的领导地位和作用。

The 19 th National Congress of the Communist Party of China revised the Party Constitution and ＂ the Thought of Xi Jinping on Socialism with Chinese Characteristics for a New Era＂ became the guiding ideology of the CPC. It is the development of the ＂ Deng Xiaoping Theory＂ stipulated by the Constitution which determines that they have an inherent consistency. It has the normative effect not only on the Chinese Communist Party,state organs,but also on citizens and social organizations. Moreover,the Party＇s guiding ideology confirmed by the Party constitution has been ratified by the Constitution as the guiding ideology of the country which is also a form of constitutional change in our country. This fully reflects the leadership and role of the Chinese Communist Party.
