宪法修改有序推进的理论逻辑、制度逻辑与现实逻辑审视

The Theoretical,Institutional and Practical Logics of the Orderly Implementation of Constitution Amending

对现行宪法进行第五次修改,是事关全局的重大政治活动和重大立法活动,事关党和人民事业顺利发展的重大制度安排,事关深化依法治国实践战略举措有效落实的顶层设计,必须积极稳妥有序推进。在宪法修改过程中,必须坚持理论逻辑、制度逻辑和现实逻辑的共同审视,保证宪法修改方向的政治正确,保障宪法修改有序推进。在宪法修改的过程中共同审视理论逻辑、制度逻辑和现实逻辑,主要表现为:宪法修改建议的提出必须坚持党的主张与人民意志有机统一的理论逻辑;宪法修改遵循的原则必须坚持党的领导、人民当家作主与依法治国有机统一的制度逻辑;宪法修改内容的确定必须坚持顺应党和人民事业发展要求与遵循宪法法律发展规律有机统一的现实逻辑。

The fifth amendment of the current Constitution is an important political and legal activity relating to the overall situation, an important institutional arrangement relating to the smooth development of the undertaking of the Party and the people, and a top - level design relating to the effective implementation of the strategic measure of rule of law and therefore, must be carried out actively, steadily and orderly. During the process of constitution amending, we must persist in jointly considering the theoretical, institutional and practical logics, so as to ensure the political correctness and orderly implementation of constitution amending. The joint consideration of the theoretical, institutional and practical logics of constitution amending is embodied in the following points ： the proposals of amendment must be brought forward according to the theoretical logic of organically unifying the People＇s advocacy with the people＇s will; the principles of amendment must conform to the institutional logic of organically unifying the Party＇s leadership with the people＇s sovereignty and the rule of law; and the determina-tion of the contents of amendment must adhere to the practical logic of organically unifying the development re-quirements of the Party and the people＇s undertaking with the regularities of development of constitution and laws.
