边疆民族地区法治初论——基于法治中国的理论演绎

Discussion on the Rule of Law in the Frontier Ethnic Areas:The Theoretical Deduction Based on the Rule of Law in China

法治的实现,既需要根据法治的一般原理,遵从法治的普遍原则和基本规律,也需要注重法治的地方特色,寻找大国治理当中的"特色"语境。其中最重要的特色语境是通过法"治"边疆、法"治"民族和法"治"区域,实现法治的疆域性推进、族群性推进和区域性推进,进而构建完整的、体系化的以及具有规律性的边疆民族地区法治。法治中国,不仅是法治规训下统一性的中国,也是法治规训下具体性的中国,二者构成完整的理论体系,并能成为推动中国法治发展的合力。

The realization of the rule of law requires not only the general principles of the rule of law,the general principles and basic laws of the rule of law,but also the local characteristics of the rule of law,and the ＂characteristic＂context in the governance of great powers. The most important characteristics of the context are the ＂governance＂of the border areas,the ＂rule of law＂and the ＂rule of law＂area,to realize the territorial promotion of the rule of law,the promotion of ethnic groups and regional advancement,and then to build a complete,systematic and regular border area of the rule of law in the border areas. The rule of law in China is not only a unified China under the rule of law,but also a specific China under the rule of law. The two constitute a complete theoretical system and can be a joint force to promote the development of the rule of law in China.
